1. Acceptance of Terms

By accessing or using DrawTheArt ("the Service"), operated by DrawTheArt ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We may update these terms from time to time and will notify you of material changes by posting the updated terms on our website.

2. Account Registration

To access certain features, you must create an account using Google OAuth. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You agree to provide accurate, current, and complete information and to update it as necessary. You must be at least 13 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these terms.

3. Content Ownership & License

You retain full ownership of all original content you create using DrawTheArt. By uploading content to the Service, you grant us a limited, non-exclusive license to store, display, and process your content solely for the purpose of providing the Service to you. We do not claim ownership over your designs, images, or other creative works. Templates and assets provided by DrawTheArt remain our intellectual property and are licensed to you for use within the platform.

4. Prohibited Use

You agree not to use the Service to:

• Upload, create, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Infringe upon the intellectual property rights of others
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Use the Service for any form of spam, phishing, or fraudulent activity
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated tools to scrape, crawl, or extract data from the Service without prior written consent

5. Subscriptions & Payments

DrawTheArt offers both free and paid subscription plans. Paid subscriptions are billed in advance on a monthly or annual basis through our payment partner, PayU. All fees are quoted in Indian Rupees (INR) and are inclusive of applicable taxes. You may cancel your subscription at any time; your Pro features will remain active until the end of the current billing period. Refunds are handled on a case-by-case basis in accordance with applicable consumer protection laws.

6. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may request a copy of your data before account deletion. We will make commercially reasonable efforts to allow you to export your content before termination takes effect, except in cases of serious policy violations.

7. Limitation of Liability

To the maximum extent permitted by law, DrawTheArt and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising under these terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

8. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes by posting a notice on the Service or by sending an email to the address associated with your account. Your continued use of the Service after such changes constitutes your acceptance of the new terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in India.
